The feds know that they have NO “Legislation,” (i.e., NO “Authority”), over the Malheur Wildlife Refuge in Oregon, millions of acres of land in other states and persons with rights in the land.

"Our Founding Fathers wrote Article 1, Section 8, clause 17 of our Constitution VERY CLEARLY and did NOT intend that their words be considered as only ink on paper. Neither did any of our Founders intend for “We the People of the United States” to be governed by a centralized power. Instead they permitted the feds legislative authority ONLY within “ten Miles square” (now DC) and in the “Places purchased” ONLY “for the Erection of Forts, Magazines, Arsenals, dock- Yards, and other needful Buildings; —“
It is NOT difficult to understand the words “other needful Buildings” in that same sentence. They are “Buildings” ONLY to supplement the aforementioned purposes, NOT for wildlife refuges, NOT for reservations, NOT for monuments, NOT for parks, NOT for land management, NOT to obtain mineral rights, and NOT to obtain jurisdiction over persons who have rights in a state’s land."
